What is a power of attorney, and why do you need one?
Nothing in life is certain. As unpleasant as it is to think about, things can change in the blink of an eye. Have you ever considered what would happen to your finances, your health, your business, and even the welfare of your family, if you lost the capacity to manage your own affairs?
This is why granting a power of attorney is such an important step to take. In the event that you are no longer in a position to look after your own finances, administrative matters or health, a trusted individual, appointed by you, can step in to manage them on your behalf.
There are two types of power of attorney that our solicitors here at Shiells can support you in granting. These are Continuing Powers of Attorney and Welfare Powers of Attorney.
Welfare Powers of Attorney
A Welfare Power of Attorney relates to your future health or personal welfare. This can include making decisions regarding the treatment and medication you receive, in addition to your daily routine such as washing, dressing, eating and other aspects of personal care.
These powers cannot be exercised until you have lost the capacity to make these sorts of decisions for yourself.
Continuing Powers of Attorney
Continuing Powers of Attorney grant the appointed person to make decisions on your behalf regarding money and property. Unlike the Welfare Power of Attorney, this can be used while you are still capable of making such decisions for yourself, as well as during such a time when you have lost the capacity.
